Supreme Court expresses displeasure over pleas filed before it on local issues, directs Kerala High Court to decide on captive elephants

The Supreme Court on Tuesday came down heavily on a proliferation of intervention applications (IAs) filed in this court on pending cases, stating that it was not the job of the Apex Court to run the country.

The observation was made by Chief Justice of India (CJI) DY Chandrachud during the mentioning of an intervention application (IA) relating to captive elephants in Kerala.

The CJI said the Apex Court was not there to deal with local issues. The High Court had ‘seasoned’ judges, who understood the local conditions and if the High Court made an egregious error, then the top court of the country could look into it, added the CJI.

Mentioning the matter, Senior Advocate CU Singh alleged that there were large scale violations of rules in the present case.

When the Apex Court asked why the intervenor could not raise the issue before the Kerala High Court, Singh said that a larger batch of petitions concerning the issue was pending before the top court.

Total 135 elephants have died in captivity in Kerala from 2018 to 2022, he added.

The Apex Court then ruled that it could not entertain everything here to make the Supreme Court dysfunctional,” the CJI said.

The Court ultimately agreed to hear the intervenor during the hearing of the main matter pertaining to the issue of elephants in captivity and listed the matter for hearing in December.
