Rajasthan High Court imposes Rs 10000 cost on petitioner for objecting to construction of petrol pump in catchment area

The Rajasthan High Court imposed a cost of Rs.10,000/- on the Petitioner and dismissed a Public Interest Litigation (PIL)  filed by the petitioner taking strong objection to the construction of petrol pump on the land  which is said to be adjacent to Khasra  said to be under catchment area.

According to the counsel for the petitioner, the place where the petrol pump is being constructed, is adjacent to the catchment area and in case of excess rain fall, the area has to be kept open for flow of rain water.   

The Division Bench of Acting Chief Justice Manindra Mohan Shrivastava and Justice Rajendra Prakash Soni have gone through the contents of the petition and various reports, which have been placed on record. 

The Court finds that the land, on which the petrol pump is being constructed is part of the khatedari land. The erstwhile owner sold part of this land (two bighas) to the private respondent  on which patta has been granted for construction of petrol pump.

“There is no merit in the present writ petition and same is, hereby, dismissed with cost of Rs.10,000/-. The said amount be deposited with Legal Service Authority within one month”, the order reads.
