Rajasthan High Court dismisses PIL against state’s Right To Health Act

The Rajasthan High Court’s Jaipur Bench has dismissed a Public Interest Litigation (PIL) by Dr. Narendra Kumar Gupta, a 70-year-old resident of Chittorgarh, Rajasthan. 

The petition was heard by Chief Justice Manindra Mohan Shrivastava and Justice Ashutosh Kumar.

The court dismissed the petition due to the petitioner’s failure to conduct proper research and gather information regarding the services implemented by the respondents in compliance with the Rajasthan Right to Health Act, 2022. 

The petitioner’s prayer for direction to frame rules and regulations was deemed insufficient.

The court noted that without concrete evidence of non-compliance with the Act of 2022 and inadequate health facilities, no notice could be issued. 

Although the PIL petition was dismissed, the court granted the petitioner liberty to file a proper petition.
