Punjab and Haryana High Court dismisses PIL on penalties for overloaded trucks

The Punjab and Haryana High Court recently dismissed a Public Interest Litigation (PIL) over the implementation of penal provisions for vehicle overloading under Section 194 of the Motor Vehicles Act, 1988.

The PIL had been filed by one Ravinder Kataria. He had previously submitted a representation to the respondent authorities on April 18, 2022 but due to the passage of time, its effectiveness may have lapsed. 

The court, comprising Chief Justice Sheel Nagu and Justice Anil Kshetarpal, chose not to comment on the case’s merits and instead granted Kataria the liberty to file a fresh representation within 30 days, along with a copy of the order.

The respondent authorities are directed to decide on this representation as expeditiously as possible, preferably within 30 days.
