Madras High Court disposes petition seeking directions to TN government to restrain use of aluminium, plastic in cartons of Indian Made Foreign Liquors

The Madras High Court disposed a petition seeking direction State of Tamil Nadu) to restrain from issuing any order or direction enabling the Indian Made Foreign Liquor Manufacturing companies to use the “Tetra Pack Cartons or any other similar type of packaging that use any form of plastics and aluminium in their cartons for filling the Indian Made Foreign Liquors in it.

The Petition is filed by one S.Prathab.

K.Sathish Kumar , counsel for the respondent submits that an Expert Committee has been constituted to study the pros and cons of use of tetra packs and also for introduction of the scheme of buying back of bottles throughout the State of Tamil Nadu. As far as the use of tetra packs is concerned, the Committee is yet to submit the report.

In the light of the above, the Division Bench of Chief Justice Sanjay V. Gangapurwala and Justice D. Bharatha Chakravarthy held that at present, no orders can be passed in the petition.

“Depending upon the report of the Committee, it will be open for the aggrieved person to take up appropriate proceedings”, said the Bench.
