The Gujarat High Court dismissed a Public Interest Litigation (PIL) filed seeking directions to the authorities not to take action against any of the wine shop owners (license holders) of the State of Maharashtra, who are unnecessarily involved in cases of Gujarat Prohibition Act, 1949.
The PIL has been filed by Association Of Progressive Retail Liquor Vendors.
The Division Bench of Chief Justice Sunita Agarwal and Justice Aniruddha P. Mayee held that this is a wholly misconceived petition filed in the name of Association of Progressive Retail Liquor Vendors, registration certificate of which is not placed before the Court.
The petitioner association claims to be an association of wine shop owners having wine shops in Districts Mumbai, Thane and Palgar in the State of Maharashtra.
From the prayer clause of the writ petition itself, it is evident that no such order can be passed as for any action against the individual shop owner, he can avail remedy available in law.
