The Gauhati High Court issued notice on a Public Interest Litigation (PIL) filed challenging the Notification issued by Principal Secretary (Home), Government of Arunachal Pradesh whereby the Special Investigation Cell under the Vigilance Department, Government of Arunachal Pradesh has been created for investigation of all the cases against public servants involving offence punishable under the Prevention of Corruption Act, 1988 and the relevant provisions of Indian Penal Code and all other Cognate Acts and Rules in force.
The PIL has been filed by one Dr. Biri Arun.
It is the submission of the counsel for the petitioner that such creation of Special Investigation Cell deprives the common people to file FIR/complaint against the public servant as any FIR/complaint is to be filed only at Police Station, SIC, Itanagar, which is against the mandate of the law.
While considering the PIL , the Itanagar Division Bench of Justice Parthivjyoti Saikia and Justice Kardak Ete issued notice to the Respondents.
N. Ratan, Additional Advocate General, Arunachal Pradesh has entered appearance and accepted notice on behalf of all the respondents, no formal notice need be issued. However, the petitioner shall furnish requisite extra copies of the petition to the Additional Advocate General for the State, the Court directed.
