The Calcutta High Court dismissed a Public Interest Litigation (PIL) filed to fish out evidence with regard to the activities done by 45 clinical establishments in the State of West Bengal, which have been granted land by the Government.
The petitioner claimed to be a member of the West Bengal State Consumer Protection Council, Consumer Protection Council, Department of Consumer Affairs, Government of West Bengal.
The Division Bench of Chief Justice T. S. Sivagnanam and Justice Hiranmay Bhattacharyya held that it is for the petitioner to prima facie establish that the terms and conditions of the grant has been violated and the Court cannot be used as a tool to collect information on behalf of the petitioner.
This aspect of the matter should be well within the knowledge of the petitioner, who claims to be a member of a West Bengal State Consumer Protection Council, Consumer Protection Council, Department of Consumer Affairs, Government of West Bengal.
Therefore, on the materials placed before the Court, direction as sought for in the petition, cannot be granted and the same is dismissed. However, this will not prevent the petitioner from approaching the appropriate authority by way of proper representation furnishing specific information , the court directed.
