Taking cognisance of controversial remarks made recently by Justice Shekhar Kumar Yadav of the Allahabad High Court, the Supreme Court has directed the High Court to provide details and particulars in the matter.
Sources said that the administrative side of the Apex Court has called for details from the High Court regarding the remarks made by Justice Yadav during an event on December 8, organised by the legal cell of Vishwa Hindu Parishad (VHP). They added that the matter was under consideration.
Speaking during an event on ‘Uniform Civil Code: A Constitutional Necessity,’ Justice Yadav said that Hindustan would function as per the wishes of the majority community.
Clarifying that he was not speaking as a High Court Judge, Justice Yadav said that the law in India operated in accordance with the bahusankhyak (majority). He said this should be considered in the context of a family or society – only what ensured the welfare and happiness of the majority would be accepted.
Using a term against a minority community, Justice Yadav said that although using the word may not be the right thing to do, he would not hesitate to say it because the members of the community were harmful and detrimental to the country. They were working against the nation, inciting the public.
Referring to the minority community members as extremists, Justice Yadav said they did not want India to progress, and the country needs to be cautious of them.
He further said that children in one community were taught the values of kindness & non-violence and its people are raised to be tolerant. In another community, however, it would be difficult to expect tolerance from children, especially when they were witnessing slaughter of animals in front of them.
He said while women were revered as goddesses in Hindu scriptures like the shastras and vedas, members of a particular community still claimed the right to have multiple wives, engage in Halala, or practice Triple Talaq.
Speaking about the Uniform Code of Conduct (UCC), he said he was sure the country would enact soon a uniform law.
The remarks evoked a strong response from different quarters, with people demanding the impeachment of the sitting judge, and withdrawal of judicial work from him in the meantime.
