A petition filed in the Supreme Court on Saturday challenged its earlier verdict on the remission given to 11 persons, who were convicted for gangraping Bilkis Bank and murdering her family members during the Gujarat riots of 2002.
Filed under Article 32, the petition contended that two Benches of the Apex Court with equal strength of two judges had delivered contradictory orders on whether the remission should be decided by the Gujarat or the Maharashtra government.
The proper course should have been to refer the matter to a larger bench for reconsideration, noted the petition, filed by one of the 11 convicts in the case.
