Allahabad High Court stays criminal case against three persons

The Allahabad High Court has stayed the proceedings of the criminal case pending in the court of Civil Judge Chhibramau against Gajendra and two others, residents of Vishungarh police station area of Kannauj.

A Single Bench of Justice Sanjay Kumar Pachori passed this order while hearing an application filed by Gajendra And 2 Others.

The 482 Cr.P.C application has been filed to quash the entire proceedings of Criminal Case under Sections 504, 506 IPC, P.S Vishungarh, District Kannauj as well as cognizance/summoning order dated 12.12.2023, pending in the Court of Civil Judge (J.D),/Judicial Magistrate Chhibramau, District Kannauj.

Counsel for the applicants submitted that the impugned F.I.R dated 22.10.2023 has been lodged on the basis of false and frivolous allegations with ulterior motive and only to harass the applicants.

It is further submitted that as per allegation of the FIR as well as pre-summoning evidence, no offence punishable under Sections 504, 506 IPC is made out.

The Court observed that prima facie, matter requires consideration.

The Court granted two weeks time to file counter affidavits for the opposite party no 2 and one week time to file a rejoinder affidavit. List after eight weeks.

Until further orders of the Court, further proceedings of aforesaid Criminal Case shall remain stayed against the applicants, the court ordered.
