The Allahabad High Court has issued notice to Samajwadi Party’s MP Chhotelal Kharwar on the election petition of Rinki Kol, who contested the last Lok Sabha elections from Robertsganj seat of Sonbhadra as a BJP-Apna Dal candidate.
A Single Bench of Justice Shekhar B Saraf passed this order while hearing an Election Petition filed by Rinki Singh.
The election petition has been filed praying for declaring the election of Chhotelal/respondent No1 as Member of Parliament from 80, Robertsganj (SC), Lok Sabha, Sonbhadra/Chandauli, U.P as null and void.
The Court issued notice to respondent No1 by ordinary process as well as by registered post in terms of Rule 6 of Chapter XV-A of the Allahabad High Court Rules,1952, returnable at an early date. Publication can also be made in terms of Clause (b) of Rule 6 of Chapter XV-A of the Rules. Steps will be taken within a week.
“On or before the next date fixed, the respondent No1 shall appear and answer the claim and if he wishes to put up the defence, he shall file his written statement together with a list of all documents whether in his possession or power or not, upon which he intends to rely as evidence in support of his defence, in terms of Rule 5 of Chapter XV-A of the Rules.
In default of appearance being entered by respondent No1 on or before the date fixed, the election petition may be heard and determined in his absence”, the order reads.
The Court has fixed the next hearing of the petition on September 12, 2024.
