The Gauhati High Court’s Itanagar Bench has directed the petitioner to file an additional affidavit providing detailed particulars in a Public Interest Litigation (PIL) filed against the State of Arunachal Pradesh and others.
The PIL, filed under Article 226 of the Indian Constitution, alleges non-compliance with the Detailed Project Report (DPR) for the construction of the Tabyer to Yangte PWD road and violation of the CPWD Manual.
The petitioner, an advocate and social activist, filed the PIL citing irregularities in the road construction project, which was sanctioned for 5.22 km but deviated from the original plan, with only 2.27 km constructed.
Despite issuing a pleader notice to the Executive Engineer and applying through RTI, Tunar received no response.
The bench of Justice Mitali Thakuria and Justice Budi Habung directed:
1. Additional Affidavit: The petitioner to file an additional affidavit providing detailed particulars.
2. Respondent’s Instructions: Respondents 1-5 to take instructions from the concerned authority and present materials before the court.
3. Next Hearing: The matter is listed for hearing on November 18, 2024.
