The Allahabad High Court has rejected the bail application of Samajwadi Party (SP) block chief of Kaudihar, Prayagraj Mohammad Muzaffar.
A Single Bench of Justice Siddharth passed this order while hearing a Criminal Misc Bail Application filed by Mohd Muzaffar.
The bail application has been filed on behalf of the applicant, Mohd Muzaffar, with a prayer to release him on bail in Case under Sections 419, 420, 429,120B IPC, Section 3/5A/8 U.P Prevention of Cow slaughter Act,1955 and section 11 (gha)(da)(ta) of Prevention of Cruelty to Animals Act Police Station Soraon, District- Prayagraj, during pendency of trial.
There are certain averments made in the bail application, which requires reply by the A.G.A, but counsel for the applicant was bent upon to argue the case itself.
He has argued the case for 15 minutes but his arguments cannot be replied to by the A.G.A for want of instructions. Applicant has criminal history of 37 cases.
AGA has vehemently opposed the prayer for bail of the applicant and submitted that without proper institutions regarding factual averments made in the bail application he cannot assist the court. Counsel for the applicant is not permitting him to obtain instructions.
“The Court after hearing the counsels for the parties does not find any ground for enlarging the applicant on bail at this stage. Bail application cannot be decided on one sided factual averments”, the Court said while rejecting the bail application.
“The court below is directed to conclude the trial against the applicant, as expeditiously as possible, preferably within a period of six months from the date of production of certified copy of the order.
In case a second bail application is filed by the applicant, it shall not be placed before the Bench”, the Court ordered.
