The Madhya Pradesh High Court has remarked that during the period of election, there is no question of senior or junior that is involved in these places.
The Division Bench of Chief Justice Ravi Malimath and Justice Vishal Mishra dismissed a Petition seeking direction to the District Collector-Cum-District Election Officer not to post petitioners in election duties of State Legislative Elections of Madhya Pradesh 2023 under someone who is below in rank and grade to the petitioners.
The grievance of the petitioners is that in view of them being sent for election duty, there is every possibility of them having to work under an officer who will be junior to them.
However, on considering the contentions, the Bench do not find the same will be accepted.
“The work that has been assigned to government officials are only for a very temporary period to do election duty. During the period of election, there is no question of senior or junior that is involved in these places. The Election Commission would appoint persons in order to ensure that the elections are done in just and fair manner. There are no malafides that are involved. Ultimately, election has to be done peacefully. The question of senior or junior in this frame of elections would not arise for consideration”, the order reads.
