As per the direction issued by the Supreme Court as well as the principal bench of the tribunal for restrictions on the use of fire crackers,the National Green Tribunal (NGT) at Bhopal has asked for strict compliance of the order.
A coram consisting judicial member Justice Sheo Kumar Singh,expert member Dr Afroz Ahmad said that that nobody can be allowed to infringe on the fundamental right to health under Article 21 of the Constitution of India under the guise of celebrations.
“The coram believed that the Celebration cannot be at the cost of the other’s health and no one can be permitted to infringe the right to health of the others, guaranteed under Article 21.
NGT moreover said that this is more in particular with the health and well being of kids and elderly.
The tribunal also clarified that this is not to be read as total ban on the use of firecrackers.
It further clarified that only those firecrackers which are p found injurious to the health of citizens, particularly children and the elderly have been banned.
The NGT also warned authorities not to permit the use of any banned crackers under the guise of celebrations.
